Philosophers have long agreed that moral responsibility might not only have a freedom condition, but also an epistemic condition. Moral responsibility and knowledge interact, but the question is exactly how. Ignorance might constitute an excuse, but the question is exactly when. Surprisingly enough, the epistemic condition has only recently attracted the attention of scholars, and it is high time for a full volume on the topic. "The overall aim of this book is to understand the character of moral progress, so that making moral progress may become more systematic and secure, less chancy and less bloody. Drawing on three historical examples - the abolition of chattel slavery, the expansion of opportunities for women, and the increasing acceptance of same-sex love - it asks how those changes were brought about, and seeks a methodology for streamlining the kinds of developments that occurred. Moral progress is conceived as pragmatic (...) progress, progress from rather than progress to, achieved by overcoming the problems and limits of the current situation. Two kinds of problems are distinguished: problems of exclusion, found when the complaints of some people are ignored; and problems of false consciousness, present when the oppressed adopt judgments from the ambient society and do not protest their condition. Suppose that you are a doctor and that you prescribed a drug to a patient who died as a result. Suppose further that you could have known about the risks of this drug, and that you are blameworthy for your ignorance. Does the blameworthiness for your ignorance ‘transfer’ to blameworthiness for your ignorant action in this case? Many are inclined accept that such transfer can occur and that blameworthiness for ignorant conduct can be derivative or indirect in this way. In (...) this paper, we motivate a new problem for transfer proponents. Extant accounts cannot satisfactorily distinguish between agents who are blameworthy for their ignorance and their resulting ignorant conduct and agents who are blameworthy for their ignorance but not for their resulting ignorant conduct. We defend a solution that we call the ‘concern constraint’ that clearly distinguishes these cases. Our solution is distinct from the much discussed foreseeability constraint (according to which blameworthiness transfers only when the ignorant action is foreseeable), and it is less restrictive than Holly Smith's quality of will condition (according to which blameworthiness never transfers). We argue that any account of derivative or indirect blameworthiness for ignorant action should take the concern constraint on board. (shrink)

Individuals differ in their support for social change. We argue that examinations of inequality and change would benefit from consideration of underlying personality processes. New data suggest that Right-Wing Authoritarianism and Social Dominance Orientation, indicators of support for inequality, may be motivated by biologically driven personality processes, particularly those related to positive-approach motivation.

Evaluation of clinical ethics support services (CESS) has attracted considerable interest in recent decades. However, few evaluation studies are explicit about normative presuppositions which underlie the goals and the research design of CESS evaluation. In this paper, we provide an account of normative premises of different approaches to CESS evaluation and argue that normativity should be a focus of considerations when designing and conducting evaluation research of CESS. In a first step, we present three different approaches to CESS evaluation from (...) published literature. Next to a brief sketch of the well-established approaches of ‘descriptive evaluation’ and ‘evaluation of outcomes’, we will give a more detailed description of a third approach to evaluation—‘reconstructing quality norms of CESS’—which is explicit about the normative presuppositions of its research (design). In the subsequent section, we will analyse the normative premises of each of the three approaches to CESS evaluation. In this paper the current legislative landscape and the challenges researchers face in obtaining informed consent in acute situations are explored. In such situations, some current guidelines can be difficult or impossible to apply. Capacity should be formally assessed before consent is sought to ensure that vulnerable persons are neither inappropriately recruited to a study nor denied the opportunity to participate. However, there is little guidance in current legislation as to how this should be achieved. When the patient is considered (...) to be unable to provide prospective informed consent, other forms are sometimes permissible, although all have specific drawbacks. First, it is argued that a brief instrument, suitable for the acute situation, is needed to determine whether patients have the capacity to consent to clinical trials. Will brain imaging technology soon enable neuroscientists to read minds? We cannot answer this question without some understanding of the state of the art in neuroimaging. But neither can we answer this question without some understanding of the concept invoked by the term “mind reading.” This article is an attempt to develop such understanding. Our analysis proceeds in two stages. In the first stage, we provide a categorical explication of mind reading. The categorical explication articulates empirical conditions that must be (...) satisfied if mind reading is to be achieved. In the second stage, we develop a metric for judging the proficiency of mind reading experiments. The conception of mind reading that emerges helps to reconcile folk psychological judgments about what mind reading must involve with the constraints imposed by empirical strategies for achieving it. This book says Prior claims: (1) that a sentence never names; (2) what a sentence says cannot be otherwise signified; and (3) that a sentence says what it says whatever the type of its occurrence; (4) and that quantifications binding sentential variables are neither eliminable, substitutional, nor referential. The book develops and defends (1)-(3). It also defends (4) against the sorts of strictures on quantification of such philosophers as Quine and Davidson.

Institutional review boards are almost universally considered to be overworked and understaffed. They also require substantial commitments of time and resources from their members. Although some surveys report average IRB memberships of 15 people or more, federal regulations require only five. We present data on IRB meetings at eight of the top 25 academic medical centers in the United States funded by the National Institutes of Health. These data indicate substantial contributions from primary reviewers and chairs during protocol discussions but (...) little from other members, which implies that it may be possible for smaller IRBs to accomplish the same tasks with no reduction in the quality of review. The purpose of this paper is to uncover and correct several confusions about expressions, tokens and the relations between them that crop up in even highly sophisticated writing about language and logic.

Studying personal identity, the continuity and sameness of persons across lifetimes, is notoriously difficult and competing conceptualizations exist within philosophy and psychology. Personal reidentification, linking persons between points in time is a fundamental step in allocating merit and blame and assigning rights and privileges. Based on Nozick’s closest continuer theory we develop a theoretical framework that explicitly invites a meaningful empirical approach and offers a constructive, integrative solution to current disputes about appropriate experiments. Following Nozick, reidentification involves judging continuers on (...) a metric of continuity and choosing the continuer with the highest acceptable value on this metric. We explore both the metric and its implications for personal identity. Since James, academic theories have variously attributed personal identity to the continuity of memories, psychology, bodies, social networks, and possessions. In our experiments, we measure how participants weighted the relative contributions of these five dimensions in hypothetical fission accidents, in which a person was split into two continuers. Participants allocated compensation money or adjudicated inheritance claims and reidentified the original person. Most decided based on the continuity of memory, personality, and psychology, with some consideration given to the body and social relations. Importantly, many participants identified the original with both continuers simultaneously, violating the transitivity of identity relations. We discuss the findings and their relevance for philosophy and psychology and place our approach within the current theoretical and empirical landscape. (shrink)

Conversational implicatures are easy to grasp for the most part. But it is another matter to give a rational reconstruction of how they are grasped. We argue that Grice's attempt to do this fails. We distinguish two sorts of cases: (1) those in which we grasp the implicature by asking ourselves what would the speaker have to believe given that what he said is such as is required by the talk exchange; (2) those in which we grasp the implicature by (...) asking ourselves why it is that what the speaker said is so obviously not such as is required by the talk exchange. We argue that Grice's account does not fit those cases falling under (2). (shrink)

In emergency research, obtaining informed consent can be problematic. Research to develop and improve treatments for patients admitted to hospital with life-threatening and debilitating conditions is much needed yet the issue of research without consent (RWC) raises concerns about unethical practices and the loss of individual autonomy. Consistent with the policy and practice turn towards greater patient and public involvement in health care decisions, in the US, Canada and EU, guidelines and legislation implemented to protect patients and facilitate acute research (...) with adults who are unable to give consent have been developed with little involvement of the lay public. This paper reviews research examining public opinion regarding RWC for research in emergency situations, and whether the rules and regulations permitting research of this kind are in accordance with the views of those who ultimately may be the most affected. Many philosophers accept derivative blameworthiness for ignorant conduct – the idea that the blameworthiness for one’s ignorance can ‘transfer’ to blameworthiness for one’s subsequent ignorant conduct. In this chapter we ask the question what it actually means that blameworthiness would transfer, and explore four distinct views and their merits. On views (I) and (II), one’s overall degree of blameworthiness is determined by factors relevant to one’s ignorance and/or one’s subsequent conduct, and transfer only involves an increase in scope. In Tractatus, Wittgenstein held that there are null sentences – prominently including logical truths and the truths of mathematics. He says that such sentences are without sense (sinnlos), that they say nothing; he also denies that they are nonsensical (unsinning). Surely it is what a sentence says which is true or false. So if a sentence says nothing, how can it be true or false? The paper discusses the issue.

For Rudolf Carnap the question ‘Do numbers exist?’ does not have just one sense. Asked from within mathematics, it has a trivial answer that could not possibly divide philosophers of mathematics.
